La Corte pediría asistencia de Scotland Yard para analizar computador de Reyes:”Colombian Supreme Court may ask for assistance of Scotland Yard to analyze Reyes computer” (AP/El Espectador).
Headline on TV Globo and TV Record News (Brazil) today: “Colombian government expects Scotland Yard to confirm authenticity of files on Reyes computer.”
That means there are at least two versions of the story floating around, one in the future indicative, one in the future subjunctive:
- Scotland Yard will inspect computers
- Scotland Yard may (or may not) inspect computers.
Whether or not the files on the machines are authentic and have not been tampered with is a contentious issue. Never mind the chain of custody issue. See
What I think is clear, reading between the lines here, is that for legal purposes, the authenticity of the evidence has not been rigorously established by expert examination, despite the avalanche of headlines to the contrary. Furthermore, the Interpol report found that the Colombians had not adhered to international standards of evidence-handling:

La Corte Suprema de Justicia informó el jueves que estudia la posibilidad de pedir la asistencia técnica de la policía londinense Scotland Yard para el análisis de un computador con archivos del ex líder guerrillero ‘Raúl Reyes’.
The Colombian Supreme Court reported Thursday it is studying the possibility of asking for technical assistance from Scotland Yard in London in the analysis of a computer with files belonging to late FARC leader “Raúl Reyes.”
El presidente de la Corte Suprema Francisco Ricaurte, en una entrevista con la cadena radial Caracol, dijo que la Corte Suprema ya recibió esta semana de las autoridades policiales un computador decomisado por militares colombianos el 1 de marzo, tras atacar un campamento de las Farc en Ecuador, en una región cercana a la frontera.
Presiding justice Ricaurte, in an interview with Radio Caracol, said the Supreme Court received a computer this week from police authorities that was seized during the March 1 raid on a FARC camp in Ecuador, near the border.
El equipo fue remitido el lunes a la Corte Suprema por la policía judicial (Dijin) , han indicado funcionarios del tribunal.
The equipment was handed over to the Court by the judicial police (Dijin), court officials said.
Algunos documentos del computador revelarían estrechas relaciones con funcionarios de Ecuador y Venezuela, cuyos gobiernos rechazan la autenticidad de los archivos y haber prestado alguna colaboración material a los insurgentes.
Some of the documents on the computer allegedly reveal close ties with Ecuadoran and Venezuelan officials, but those governments reject the authenticity of the files and deny having collaborated in any material way with the insurgents.
Otros archivos, según las autoridades colombianas, mostrarían nexos de las Farc con políticos colombianos, ecuatorianos y venezolanos, por lo cual el 24 de abril el máximo tribunal pidió, primero al Ministerio de Defensa, y más tarde a la Fiscalía copias de la información. La solicitud de la Corte se basó en que algunas de las personas mencionadas en los archivos son legisladores colombianos, que gozan de un fuero especial y sólo pueden ser investigadas por el máximo tribunal.
Other files, according to Colombian authorities, allegedly show FARC ties with Colombian, Ecuadoran and Venezuelan politicians, for which reason the high court requested on April 24, first from the Ministry of Defense and later from the Fiscalia, copies of the information. The court’s request for information was based on fact that some of the persons mentioned in the files are Colombian legislators, who enjoy a special forum privilege under which they can only be investigated by the high court.
Ricaurte dijo que la Corte también dispone ya de un informe elaborado por la policía internacional, Interpol, realizado a pedido del gobierno, que da cuenta que aunque algunos archivos fueron abiertos por las autoridades colombianas, el equipo no fue manipulado.
Ricuarte said that the Court also has in its possession a report from Interpol, prepared at the request of the Colombian government, which notes that some of the files were opened by Colombian authorities, but that the equipment was not manipulated.

La Corte “ha conocido un informe de la Interpol donde se da cuenta de que algunos archivos del computador fueron manipulados, por eso la Corte considera importante que haya una verificación de la autenticidad de esos archivos, ello la ha llevado a considerar la posibilidad de acudir a un organismo internacional que podría ser Scotland Yard”, dijo el magistrado.
The court “has taken note of an Interpol report which states that some computer files were manipulated, and so the court considers it important to verify the authenticity of these files, which has led us to consider the possibility of asking for the assistance of an international agency, which could be Scotland Yard,” said the magistrate.
“Manipulación en ningún momento significa que se hayan alterado (archivos), manipulación significa que se abrieron…entonces por eso la sala penal de la Corte considera que es importante, para el éxito de cualquier investigación, establecer la autenticidad de esos archivos”, aseguró el magistrado.
“‘Manipulation’ [does not necessarily] implies that files were altered, ‘manipulation’ means they were opened … so the criminal section of the Court considers it vital to the success of any inquiry to establish the authenticity of these files,” the magistrate stated.
Será “el organismo internacional el que escoja la sala penal de la Corte, puede ser Scotland Yard, quien determine si esa manipulación tuvo algún otro efecto”, indicó Ricaurte sin precisar cuándo el tribunal tomaría su decisión sobre qué organismo la asistirá y cómo se haría ese proceso.
It will be “the international agency that the high court chooses, possibly Scotland Yard, that will determine whether this manipulation had any other effect,” Ricaurte indicated, without detailing when the Court might make its decision over which agency it will make the request to and how the process will work.
