DEU EM O GLOBO: The Rio metro daily reported today that the state elections tribunal, which rejected a federal offer to send a special civilian police force, the FNSP, to assist in combating “electoral corrals” formed by militias and other armed criminal gorups, has approved a plan to send Army troops to Rio to keep order during the municipal elections.
That ought to sit well with the IOC when they mull Rio’s candidacy for the 2016 games.

TSE aprova Forças Armadas na campanha do Rio, medida inédita apoiada por Cabral
Federal elections tribunal approved the armed forces for Rio election campaign, an unprecedented measure supported by Governor Cabral.
That is, The Armed Forces, supervised by the Ministry of Defense, and not the FNSP, a civilian paramilitary police force of the Ministry of Justice.
But it is not exactly clear that O Globo is not reporting a non-existent fact here.
I read in reports from other news agency — the Estadão among them — that it is the FNSP that is being approved for deployment here — an “armed force” — and not The Armed Forces.
O Globo has tended to have trouble with this distinction in the past. It seems to be stuck in a period in history in which the civilian authorities were subordinated to the military and not vice versa — a situation from which, after all, it profited greatly.
OTribunal Superior Eleitoral (TSE) autorizou ontem o envio de tropas militares ao Rio de Janeiro para garantir a segurança do processo eleitoral, já durante a campanha, assim que o governador Sérgio Cabral for ouvido sobre o assunto. Por telefone, ontem, Cabral solicitou a ajuda das tropas federais ao presidente da Corte, ministro Carlos Ayres Britto. Agora, ele será consultado formalmente. Mesmo que mude de posição, o tribunal manterá a medida. Isso porque uma resolução do TSE determina que o governador do estado apenas se manifeste sobre o tema, não importando sua opinião para a decisão final.
The federal elections tribunal (TSE) yesterday authorized the sending of military troops to Rio de Janeiro to guarantee the security of the election process during the campaigning phase, just after hearing Governor Cabral’s views on the subject. Cabral telephone chief elections justice Ayres Britto to make the request, which will now be made through formal channels. Even if it changes its position, the court will keep the measure in place. This because a TSE resolution determines that the state government is only required to give an opinion on the subject. His opinion is not taken into consideration in the court’s final decision.
I have no idea what that means.
Quando tropas militares forem deslocadas para o Rio, será a primeira vez que a medida será realizada por tanto tempo num processo eleitoral. Normalmente, a pedido de governadores ou tribunais regionais, o TSE autoriza o envio de militares a cidades ou estados só no dia das eleições, para garantir a votação. O TRE do Rio, porém, descartou o pedido das tropas recentemente, e ontem não quis se manifestar sobre a decisão do TSE.
If military troops are dispatched to Rio, this will be the first time such a measure has been implemented for such an extensive period during the elections process.
Wake me when it actually happens. There is nothing more dubious than a news report containing a contrary-to-fact condition about future possibilities.
Normally, at the request of governors or regional elections tribunals, the TSE authorizes the sending of troops to cities or states only on election day, to guarantee the security of voting. The regional elections authority of Rio, however, recently ruled out the sending in of troops, and yesterday had no comment on the ruling by the TSE.
Yes, normally, this is a measure in which you see The Armed Forces being dispatched to tiny, ultraviolent rural municipalities in, say, Tocantins or Amapá.

Os militares começariam a trabalhar imediatamente, com as polícias estaduais e a Polícia Federal, que integram a força-tarefa criada para coibir a atuação do tráfico e das milícias em comunidades carentes. As tropas atuariam para dar garantia às campanhas de candidatos, nas votações e na apuração dos votos.
The troops would start working immediately with state and federal police, who are part of a task force created to inhibit the activities of drug traffickers and militias in poor communities. The troops would provide security to the campaigns of candidates, to the voting process and to the counting of votes.
I really do think what we are talking about here are the FNSP, not the Armed Forces.
- Já estive por três vezes ao telefone com o governador Sérgio Cabral, hoje (ontem) inclusive, e ele repetiu para mim o que tem dito à imprensa: que uma eventual requisição de forças policiais militares, por parte do TSE, encontrará por parte dele todas as boas vindas – disse Ayres Britto, ao abrir o debate na sessão de ontem.
“I have now talked to Governor Cabral three times on the phone, and he reiterated to me what he told the press, that a possible requisition of federal troops by the TSE would be welcomed by them,” said Ayres Britto, upon opening the debate in the TSE’s session yesterday.
Por sua assessoria, Cabral classificou como bem-vinda a decisão do TSE, e disse que vai acatá-la. Cabral disse considerar importante todo o apoio que ajude na garantia da democracia, para prevalecer o direito do eleitor. Após a sessão, Ayres Britto disse que Cabral não deve ser manifestar oficialmente hoje, mas previu que “não vai demorar”. O ministro disse que o TSE está mapeando as áreas mais delicadas, e que a atuação das tropas militares não será em toda a cidade:

No início da sessão, Ayres Britto relatou seus encontros recentes com autoridades do governo federal e do governo do Rio da área de segurança. Disse que ficou impressionado com a presença de traficantes e de milícias em favelas, que apóiam um determinado candidato e proíbem os outros de fazerem campanha no local. O ministro também demonstrou preocupação com a mensagem passada pelos grupos criminosos, de que a urna eletrônica é violável e, assim, seria possível saber em quem o eleitor votou:

- Cabe ao TSE assegurar a lisura do processo eleitoral. Temos o inarredável dever de sair da inércia, do marasmo, do conformismo. Não nos é dado o direito de rendição – afirmou.

O ministro também contou ter recebido uma carta do procurador de Justiça do Rio, Marfan Martins Vieira, na qual ele teria pedido a presença dos militares para garantir a segurança das eleições. O ministro Carlos Alberto Direito propôs que o TSE autorize logo o envio de tropas e deixe os militares à disposição do governo fluminense. Ele comparou a um regime feudal o comportamento do crime organizado no Rio, dizendo que há candidatos eleitos pelos criminosos e outros, impedidos de fazer campanha nas favelas.

Direito argumentou que o Código Eleitoral dá poderes ao TSE para requisitar a ajuda dos militares sem a necessidade de ouvir outras autoridades. O vice-procurador-geral eleitoral, Francisco Xavier, concordou:

- A campanha está nas ruas. A solução preconizada pelo ministro Direito vai ao encontro do anseio da sociedade.
O ministro Ari Pargendler lembrou, porém, que o TSE aprovou uma resolução determinando que, no caso da necessidade de tropas federais, é preciso ouvir antes o governador.
- Se o governador acha que não tem condições de garantir a regularidade das eleições, ele tem que requerer (as tropas militares) – disse Pargendler, frisando que o problema do Rio é de segurança pública, uma área de atuação do governo estadual.
Ayres Britto rebateu:
- A requisição de forças federais, com Exército, Marinha e Aeronáutica, faria da ostensividade da polícia um acréscimo a deixar mais confortados candidatos, comunidades e imprensa, que tem o direito de fazer a sua cobertura. Isso transcende o conceito de segurança pública.
Todos os ministros se convenceram de que, segundo a resolução do TSE, é mesmo necessário ouvir Cabral.
