Fumus Boni Iuris | Globo Pants on Fire in Crowded Electoral College?

New and noted.

Before setting out to become the Ariana Huffington of Brazil — ! — journalist Paulo Henrique, ex-Globo and currently a special reporter for the rival Record network — published some serious work on electronic voting fraud with the collusion of the Globo network in Rio de Janeiro in the late 1980s.

He now reports that the Globo network could be prosecuted for election fraud in an incident involving doctored videotape presented on the national prime-time newscast, Jornal Nacional.

This was the infamous “wadded up piece of paper” that opposition politicians such as Governor Goldman turned into “a vicious assault by fascist thugs” during the election campaign.

The gist of the criminal complaint, filed by a São Paulo state legislator, and activist for the federal situation, and the group Tortura Nunca Mais, charges that the opposition’s national candidate used fraudulent video footage, created by Globo, during programs produced for and aired during its free political air time.

In theory, this is a crime punishable by up to two years in jail under Article 323 of a law passed in 1965

Divulgar, na propaganda, fatos que sabe inveridicos, em relação a partidos ou candidatos e capazes de exercerem influência perante o eleitorado:

Is this law applied? It seems to be, from time to time.

In a minor race in Maranhão this year, a man was convicted of circulating a mendacious libel — in the classical definition of the term — in a bid to deceive voters. In Patanduva in 2008, a campaign finance director was criminally convicted under Article 323

On the eve of the vote, pamphlets were handed out in  Planalto Norte criticizing the opinion polls conducted on behalf of the  PMDBand DEM, which had been impugned by the elections authorities. The pamphlets led readers to believe that the polls were impugned because they used “push polling” to induce voting againt PSDB candidate Sidnei Ziezkowski. A bench warrant led to the seizure of 2.937 copies of a 10,000-copy print run at PSDB campaign headquarters, and Sérgio Ramos and four other PSDB campaign officials were indicted..

The important point is that the Regional Elections Prosecutor is recommending opening an investigation into the merits of the facts alleged: That Globo produced and aired fraudulent video that was then re-aired as part of a knowingly false and misleading political advertising campaign

I would certainly like to know the answer to these factual questions. (more…)

WikiLeaks | “Uncle Sam Believes What He Reads in the Brazilian Press”

Any reasonably tech-savvy teenager would have known the document was a forgery

I feel it is my patriotic duty to report that U.S. diplomats are being mocked by credible Brazilians for “believing what they read in the Brazilian press.”

And rightly so: the Brazilian press is like the water in Mexico. You have to boil it before it is fit for human consumption

Above, Luis Nassif of Brasilianas.Org — a project I participate in with the odd useful tip and quite a few pointless rants — demonstrates the manufacture of a scandal by the Estado de S. Paulo daily.

The newly appointed Minister of Institutional Relationships — the Getting Along With Congress and the Army Czar — is accused of signing off on a fraudulent transactions.

Items:

  1. The document was translated into a PDF from a document created in OpenOffice, whereas official documents are always scanned
  2. The minister’s personal ID number is incorrect
  3. The logo of the ministry diverges from its graphic standard
  4. The telephone and e-mail of the ministry are incorrect
  5. The taxpayer ID of the alleged crook is incorrect
  6. The signature of the minister is scanned

On the last point, clicking on the images shows that it is an image in some photographic format.
