The state high court of São Paulo has handed down a restraining order obliging Google to exclude sites from its search results that retransmit, live and without authorization, the TV programming of the Globo network.
The order obtained by Globo and Globosat was handed down by Judge Denise Cavalcante Fortes Martins on February 16. Yesterday afternoon, Google said it has yet to be notified, and stated that it “does not comment on specific cases.”
Attorney Maurício Joseph Abadi, of the lawfirm Manuel Alceu Affonso Ferreira Advogados, hired by Globo, says Google operates as a “criminal facilitator”because the URLs that carry the content are not searchable because they lack “intuitive”URLs”.
“Google is the only way people find and access this content”, Abadi says.
I assume this means the sites use raw URLs to disseminate the content.
For example, the URL XTREMEPAGEFUCKER.COM still redirects you to the main Web site of Brazil’s Globo media group. I wish someone would explain to me what Globo could possibly intend to accomplish, what strategy it adheres to.
A perfunctory google turns up one cheerfully amateur culture hack offering to hook you up with content from Globo and a large number of other sources.
The Terra news portal adds,
Globo’s motion mentions such sites as vertv100antena.com, assistirtvonline.net and tvgol.biz. The fine for noncompliance was set at R$ 5 thousand per day. ESPN and Discovery Kids are examples of other channels on offer through such sites. Globo’s attorney said Google had already been warned, informally, and that the greatest difficulty in dealing with these sites is that they constantly change providers.
